What Changed — Effective Oct. 9, 2026

The ATF has announced it will no longer enforce Form 1 / Form 4 approval, registration, or tax-stamp requirements for suppressors, short-barreled rifles (SBRs), short-barreled shotguns (SBSs), and any other weapons (AOWs).

Form 1 / Form 4 ApprovalNot Enforced
Registration RequirementNot Enforced
Tax Stamp ($200)Not Enforced
Machine GunsSTILL FULLY REGULATED
Destructive DevicesSTILL FULLY REGULATED
State & Local LawsSTILL APPLY

In plain terms: suppressors, SBRs, SBSs, and AOWs are now $0 tax, no approval, no registration at the federal level — but only for those four categories. Machine guns and destructive devices remain fully regulated under the NFA with the $200 tax stamp and all existing requirements intact.

What Did NOT Change

Machine Guns & Destructive Devices

The $200 tax stamp and full NFA process remain in effect for machine guns and destructive devices. This policy change does not touch those categories.

State and Local Laws

Federal non-enforcement does not override state or local restrictions. If your state prohibits suppressors or SBRs, those laws still apply. Maryland residents should verify current state law before acquiring any NFA item without federal paperwork.

FFL Transfer Process

Transfers through a licensed dealer still require a standard 4473 background check. The NFA paperwork (Form 4) is what is no longer required — the background check is not going away.

ATF Open Letter & FAQ

The ATF has issued an Open Letter and FAQ explaining how FFLs and individuals should handle transfers under this new policy. The guidance covers how dealers should process suppressor and SBR transfers without the traditional Form 4 paperwork, and what documentation — if any — should be retained.

Down Range, LLC is monitoring this guidance closely and will update our transfer process accordingly. If you have questions about how this affects a pending or future transfer, reach out to us directly.

In-Stock Suppressors — Available Now

With the NFA paperwork requirement lifted at the federal level, now is a great time to add a suppressor. We currently have two Dead Air cans in stock and ready to transfer.
