Legislative / Judicial News

11% Excise Tax In Committee at the State Level

As expressed last year prior to the legislative session adjourning "sine die" ("without a day" — indicating the final adjournment of the legislative session, meaning lawmakers will not return on a specific date to continue the same session), a bill to levy an 11% excise tax upon firearms, ammunition, and accessories is now being debated in committee. This is in addition to the 6% sales tax assessed at the time of purchase for anything firearms-related.

The funds will be dispersed as follows:

Maryland Violence Intervention and Prevention Program Fund
Funds provided to reduce violence in communities.

Center for Firearm Violence Prevention and Intervention
Efforts focused on firearm-related violence prevention.

Coordinated Community Supports Partnership Fund
Revenue allocated to further enhance community support.

Survivors of Homicide Victims Grant Program
Provides monetary support for those affected by homicide.
Remainder
Maryland Trauma Physician Services Fund & R Adams Cowley Shock Trauma Center
Remaining funds split between these facilities.

Further, the legislation emphasizes that the tax revenue is meant to supplement existing funding for these programs, not replace it. The bill is currently under consideration in the Senate Budget and Taxation Committee.

Assessment

While well intentioned, the unintended consequence of this bill will encourage illicit sales, out-of-state purchases, and inflict economic hardship in the similar way the NFA (National Firearms Act) has. Unfortunately, purchasing out-of-state will not circumvent the tax on items that require a Federal Firearms Licensee to transfer them to you — the tax will be paid upon transfer of the item. That includes: pistols, suppressors, short-barreled rifles, and shotguns.

Outlook

Will it pass? Most likely. The disconnect between the polity and Annapolis is expansive and ever widening. It would behoove you to make some form of contact with the State Senator that corresponds with your district. A list has been compiled for those residing in Washington and Frederick Counties. If you reside outside of those counties, please contact us for assistance in finding your representation.

Maryland State Police Procedural News

Designated Collector — Now Online

If you are not a "designated collector" by definition of the State, you can now accomplish this on the Maryland State Police Licensing Portal. You no longer need to have the physical form notarized and mailed to State Police. They will accomplish it much like your other licensing requirements — just no longer in paper form.
